Lay Low Transport – Terms & Conditions

Introduction
By booking transport with Lay Low Transport, you agree to the following Terms and Conditions. These terms outline your rights and responsibilities as a customer and our obligations as your transport provider. They are designed to ensure safe, efficient, and transparent vehicle and goods transport services in compliance with Australian Consumer Law. Please read them carefully before confirming your booking.
1.Definitions
Customer: The person or company booking transport with Lay Low Transport.
Vehicle: Any car, trailer, or other item being transported.
Services: The transport, handling, and associated logistics provided by Lay Low Transport.
Booking: A confirmed and paid reservation for transport services.
Delivery: The successful arrival and handover of the vehicle or item to the specified recipient.
2. Booking & Payment
Full payment is required upfront to secure your booking and confirm a space on the truck.
If payment is not received, your position may be reallocated to another customer without notice.
Please use your full name and vehicle make/model as your payment reference.
It is your responsibility to ensure that all booking details (addresses, contact numbers, vehicle dimensions, and condition) are accurate and complete.
3. Cancellations & Refunds
Once booked and paid, transport fees are non-refundable, except as required by Australian Consumer Law.
Refunds may be considered if Lay Low Transport cannot complete the job due to mechanical failure or another fault directly attributable to us, and the customer arranges an alternative transporter.
No refunds will apply for delays or cancellations caused by natural disasters, floods, pandemics, government restrictions, or other events beyond our control.
4. Rescheduling
Customers may request changes to pickup or delivery dates with at least 14 days’ notice, subject to truck availability and route planning.
Requests within 14 days of transport are not guaranteed and may incur additional fees.
5. Re-Delivery Fees
If no authorised person is available at delivery despite prior notice, a re-delivery fee may apply.
Fees are calculated based on the additional travel distance or time required.
We do not charge storage fees; however, vehicles may remain on the truck or be delivered to an alternate nearby safe location at the customer’s cost.
6. Street Access & Vehicle Transfer
Our trucks are up to 19 metres long and may not access all streets or driveways.
If access is restricted, you must either:
Meet the truck at a nearby accessible location, or
Authorise our driver to carefully move your vehicle between the property and the truck.
Drivers will always do their best to assist safely and efficiently.
7. Driver Contact & Communication
Drivers will contact:
The pickup contact before collection, and
The delivery contact before drop-off.
We aim to provide 12–24 hours’ notice.
Please note that drivers may not answer while driving. Avoid repeated calls—they will respond when safe to do so.
Unless specifically arranged, we do not provide ongoing progress updates between pickup and delivery.
8. Vehicle Condition & Responsibility
Running vehicles must have adequate fuel, a working battery, and safe fluid levels (engine, gearbox, differential).
Lay Low Transport is not liable for mechanical or electrical failures, including:
Suspension issues (e.g. leaking airbags)
Starter, fuel, or battery faults
Flat tyres
We are not responsible for any issue resulting from a pre-existing condition.
9. Transport Risks – Open vs Enclosed
Open transport is provided at the customer’s own risk. Lay Low Transport is not liable for:
Stone chips
Hail damage
Bird strikes
Road debris or weather-related damage
For complete protection, enclosed transport is recommended.
10. Items Inside the Vehicle
A $100 fee applies for personal belongings transported inside a vehicle.
All contents are moved entirely at the customer’s risk. Lay Low Transport is not liable for:
Interior damage
Suspension or structural stress due to excess weight
Loss, theft, or shifting of items during transit
No items are to be placed in or around the driver’s seat. Excessive or heavy loads may incur additional charges or refusal of service.
11. Non-Running Vehicles
If your vehicle does not start or run under its own power, you must advise us before pickup.
All trucks are fitted with winches (no extra charge).
Failure to advise may result in delays or a missed pickup, which may incur rescheduling fees.
12. Loose Parts & Accessories
All parts and accessories must be declared and securely fastened inside the vehicle.
If parts cannot be safely secured, a separate vehicle space must be booked.
Any damage caused by loose items is the customer’s responsibility.
13. Crated, Boxed, or Sealed Items
For sealed, crated, or packaged goods that cannot be inspected, Lay Low Transport accepts no responsibility for the internal condition of contents.
The customer is responsible for ensuring packaging is structurally sound and for arranging insurance where necessary.
14. Delays & Unforeseen Events
While we take all reasonable steps to deliver on schedule, transport times can be affected by:
Mechanical issues or flat tyres
Road closures, floods, or accidents
Government restrictions or border delays
Lay Low Transport is not liable for delays caused by factors outside our control.
15. Our Transport Approach & Service Standards
At Lay Low Transport, our operations are built on transparency, fairness, and reliability.
Each transport job is carefully planned based on distance, logistics, and the type and value of the vehicle.
We allocate space and resources to ensure the highest standard of safety and care for every car we move, whether it’s a daily driver or a collector’s vehicle.
16. Vehicle Value & Handling
Vehicles of higher value or special category (e.g. rare, classic, or high-performance models) are handled with additional precautions.
Extra time and attention are allocated for strapping, loading, and unloading to ensure full protection.
Depending on the vehicle’s value and type, specific transport methods (such as enclosed transport) may be required for insurance and safety purposes.
17. Insurance & Fair Refund Policy
To protect both the customer and Lay Low Transport, we apply structured insurance and charge policies for high-value vehicles.
In some cases, we may apply a maximum charge to ensure full coverage during transit.
Once the vehicle is safely delivered and both parties are satisfied, any difference between the maximum charge and the actual transport cost may be refunded, reflecting our commitment to fairness and integrity.
This approach ensures we’re always prepared for unexpected issues while guaranteeing you only pay for the actual service provided when everything goes smoothly.
18. Insurance Coverage
Lay Low Transport is fully insured through NTI Australia, with $1,000,000 total load coverage per truck.
Insurance does not cover:
Minor cosmetic damage on open transport
Damage caused by mechanical faults, pre-existing conditions, or overloading
For high-value vehicles, enclosed transport or additional insurance is recommended.
19. Customer Responsibility & Indemnity
Customers must ensure that no illegal, hazardous, or prohibited goods are inside the vehicle.
By booking, you authorise Lay Low Transport staff and agents to drive or move vehicles for loading and unloading.
You warrant that you are the legal owner or authorised representative of the vehicle and agree to indemnify Lay Low Transport against any claims, losses, or damages arising from false information, unauthorised transport, or breach of these Terms.
20. Limitation of Liability
Except to the extent prohibited by law, Lay Low Transport is not liable for any indirect, special, incidental, or consequential losses, including loss of profit, business interruption, or loss of opportunity.
Our total liability for any claim, whether in contract, tort, or otherwise, shall not exceed the total amount paid by the customer for the transport service.
21. Subcontracting & Assignment
Lay Low Transport may subcontract, assign, or delegate the performance of all or part of the services to a third party without prior notice.
The customer consents to the use of such subcontractors or assignees.
22. Amendment of Terms
Lay Low Transport may amend these Terms & Conditions from time to time.
Updated terms will be published on our website and apply to bookings made after the date of publication.
23. Severability
If any part of these Terms & Conditions is found to be invalid, illegal, or unenforceable, that provision will be removed or modified, and the remaining provisions will continue in full force and effect.
24. Entire Agreement
These Terms & Conditions, together with any written quotation and booking confirmation, form the entire agreement between the parties.
No prior representation, agreement, or understanding has any effect unless expressly included in writing.
25. Dispute Resolution
In the event of a dispute, both parties agree to attempt to resolve the matter through negotiation.
If the issue remains unresolved within 14 days, the parties may agree to participate in mediation before commencing legal action.
Nothing in this clause prevents either party from seeking urgent relief in court where necessary.
26. Regulatory Compliance
Lay Low Transport complies with all applicable Australian transport and heavy vehicle regulations, including Chain of Responsibility obligations, ensuring safe and lawful operations across all services.
27. Governing Law
These Terms & Conditions are governed by the laws of Queensland, Australia.
Any disputes will be handled exclusively in Queensland courts.
28. Agreement to Terms
By placing a booking with Lay Low Transport, you acknowledge that you have read, understood, and agree to these Terms & Conditions, and that all information provided is true and accurate.
